These Terms of Service ("Terms") govern your use of the WordPress maintenance and support services provided by Vital Sites (ABN 19 357 086 272). By subscribing to any plan, you agree to these Terms.
1. Services
Vital Sites provides WordPress website maintenance, security monitoring, backup, and support services as described on our pricing page. The specific inclusions depend on your chosen plan (Essential, Care+, or Pro).
2. Subscription & Billing
- All plans are billed in advance — monthly or annually depending on your selection
- Payments are processed securely via Stripe using the payment method you provide
- Subscriptions auto-renew at the end of each billing period unless cancelled
- Prices are in Australian Dollars (AUD) and inclusive of GST where applicable
- We reserve the right to adjust pricing with 30 days' written notice
3. Cancellation
- Monthly plans: Cancel anytime via the Stripe customer portal or by contacting us. Your service continues until the end of the current billing period
- Annual plans: Cancel anytime — your service continues until the end of the prepaid year. No partial refunds for unused months (see our Refund Policy)
- Upon cancellation, we will remove our admin access to your website within 7 business days
4. Your Responsibilities
As a client, you agree to:
- Provide accurate website access credentials during onboarding
- Create a dedicated WordPress admin account for our use (not share your personal login)
- Maintain a valid payment method on file
- Notify us of any changes to your hosting, domain, or website structure
- Not use your website for any unlawful purpose
- Ensure you have the authority to grant us admin access to the website
5. Our Responsibilities
We agree to:
- Perform the services described in your chosen plan with reasonable care and skill
- Keep your website access credentials secure and confidential
- Respond to support requests within the timeframes specified for your plan
- Provide monthly site health reports (Care+ and Pro plans)
- Notify you promptly of any significant issues with your website
6. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law:
- Our liability is limited to the fees you have paid in the 3 months preceding any claim
- We are not liable for losses caused by third-party hosting failures, domain expiry, or issues beyond our reasonable control
- We are not responsible for the content on your website — you retain full ownership and responsibility for all site content
- We do not guarantee that your website will be free from all security vulnerabilities, but we take reasonable steps to minimise risk
7. Intellectual Property
You retain full ownership of your website, its content, and your domain. We do not claim any rights to your intellectual property. Any tools, scripts, or plugins we install as part of our service remain our property or the property of their respective licensors.
8. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) or equivalent state legislation that cannot be excluded, restricted, or modified by agreement.
9. Governing Law
These Terms are governed by the laws of the Commonwealth of Australia. Any disputes will be subject to the jurisdiction of the courts of Australia.
10. Changes to Terms
We may update these Terms from time to time. We will notify active clients of material changes at least 14 days before they take effect. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
